Who we are
This website and shop are run by Craig Spencer, a sole trader trading as Craig Spencer Ceramics (ABN 79 175 440 300), with studios in Australia + New Zealand. Orders are made and shipped from New Zealand. "We" and "us" mean that business. "You" means anyone using the site or buying from it.
By using the site or placing an order you agree to these terms. They're written to be read, not to trap anyone; if something here is unclear, email shop@craigspencerceramics.com before you order.
The work
Every piece is handmade. Minor variations in colour, glaze, texture, shape, size and finish are normal and are part of the work, not defects. Small marks, pinholes, speckles and kiln variations are the character of a handmade object and don't qualify a piece for a return or refund. Photographs are as accurate as we can make them, but screens differ and the piece you receive will not be identical to the image.
Where a piece is described as one of one, or as an edition of a stated size, that description is accurate at the time of listing. Dimensions given are approximate.
Unless a listing says otherwise, our stoneware is intended for use with food. Care guidance is on the Shipping & FAQ page.
Prices & payment
Prices are shown in your local currency where the shop offers it (you can change it in the shop), and orders are charged in the currency of the shipping country. Prices do not include GST, as the business is not currently registered for GST in New Zealand or Australia. Shipping is calculated at checkout and shown before you pay. Import duties, customs charges and taxes in the destination country are not included and are your responsibility.
Orders are placed and paid for through Shopify's checkout. An order is accepted when we send you a confirmation email. We may decline or cancel an order if a piece has already sold, if a price or listing was published in error, or if we can't verify payment; if we do, you'll be refunded in full. Prices may change without notice, but not for an order already confirmed.
Shipping & delivery
Our shipping arrangements, carriers, packaging, and what happens if an address is wrong or a parcel is held at customs, are set out on the Shipping & FAQ page, which forms part of these terms. Risk in a piece passes to you when the carrier delivers it to the address you gave us. Delivery times are estimates; we aren't responsible for carrier or customs delays outside our control.
Returns, damage & cancellations
All sales are final, including custom and sample pieces. Once an order is placed it can't be modified or cancelled. This does not affect your rights under the Consumer Guarantees Act 1993 (see below).
If a piece arrives damaged, keep all packaging, photograph the packaging and the piece, and email us within 48 hours of delivery. We'll look at every case individually and in good faith. Where a repair or replacement isn't possible, we'll refund you. The full process is on the Shipping & FAQ page.
Unless a piece is defective, incorrect, or damaged on arrival, you're responsible for the cost of any return shipping, and we recommend a tracked, insured service.
Your rights as a consumer
If you're buying for personal use, the New Zealand Consumer Guarantees Act 1993 gives you guarantees that goods will be of acceptable quality, fit for purpose, and match their description. Nothing in these terms limits those guarantees, your rights under the Fair Trading Act 1986, or, if you are buying in Australia, your rights under the Australian Consumer Law. Where you're buying for business purposes, you agree that the Consumer Guarantees Act does not apply.
The natural variation described under "The work" is part of what you're buying and is not a defect in quality.
This website
The photographs, words, designs and the pieces themselves are the copyright of Craig Spencer, or of the photographers credited. You're welcome to share links to the site and to share images on social media with credit; please don't reproduce images or text for commercial use without asking.
We do our best to keep the site accurate and available but can't promise it will always be error-free or uninterrupted. To the extent the law allows, we aren't liable for indirect or consequential loss arising from your use of the site. Where we are liable, our liability is limited to the price you paid for the piece concerned. Nothing here excludes liability that can't be excluded by law.
How we handle your personal information is set out in our privacy policy.
The legal bits
These terms are governed by New Zealand law and the courts of New Zealand. If any part of them is found unenforceable, the rest still applies. We may update these terms from time to time; the version on this page at the time you order is the one that applies to that order.
